1. Acceptance of Terms

By accessing or using the Baharidust Adventure website, booking a safari, or engaging with our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

These Terms apply to all visitors, users, and clients of Baharidust Adventure. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our services constitutes acceptance of any changes.

2. Booking and Payment

2.1. Booking Process

To book a safari or package with Baharidust Adventure, you must submit a booking request through our website, email, or phone. All bookings are subject to availability and confirmation by our team. A booking is confirmed only when you receive a written confirmation from us.

2.2. Deposits and Payments

• Deposit: A non-refundable deposit of 25% of the total package price is required to confirm your booking.
• Balance: The remaining balance is due 30 days before your departure date.
• Late Bookings: For bookings made within 30 days of departure, full payment is required at the time of booking.
• Payment Methods: We accept bank transfers, credit cards, PayPal, and cash payments (in person).

2.3. Pricing

All prices are quoted in US Dollars (USD) and are subject to change without notice. Prices are based on current exchange rates, park fees, and taxes. We will honor the price quoted at the time of booking, provided that your deposit is received within 7 days of the quote.

3. Cancellations and Refunds

3.1. Cancellation by Client

If you need to cancel your safari, the following cancellation fees apply:

• 60+ days before departure: Full refund of all payments (excluding non-refundable deposits).
• 30–59 days before departure: 75% refund of the total package price.
• 15–29 days before departure: 50% refund of the total package price.
• Less than 14 days before departure: No refund available.
• No-show: No refund will be issued.

All cancellations must be made in writing (email) and are effective on the date we receive your written notice.

3.2. Cancellation by Baharidust Adventure

We reserve the right to cancel a safari due to force majeure, safety concerns, or insufficient bookings. In such cases, we will offer you a full refund or the option to rebook for an alternative date. We are not responsible for any additional costs or expenses incurred by you (e.g., flights, visas, etc.).

4. Changes to Itineraries

While we make every effort to follow the published itinerary, changes may occur due to unforeseen circumstances, including:

• Weather conditions
• Park closures or restrictions
• Flight delays or cancellations
• Accommodation availability
• Government regulations

We reserve the right to modify itineraries to ensure your safety and enjoyment. Any significant changes will be communicated to you as soon as possible. We will not be held liable for any losses or expenses resulting from such changes.

5. Travel Insurance

Travel insurance is mandatory for all clients. We require that you purchase comprehensive travel insurance that covers:

• Medical expenses and emergency evacuation
• Trip cancellation and interruption
• Lost or delayed baggage
• Personal liability

You are responsible for ensuring that your insurance policy covers all activities included in your safari, including walking safaris, game drives, and optional excursions. We may request proof of insurance before your departure.

6. Health and Safety

6.1. Health Requirements

It is your responsibility to ensure that you are in good health and physically capable of participating in your chosen safari. You must consult your doctor or travel clinic for advice on:

• Required and recommended vaccinations
• Malaria prophylaxis
• Altitude sickness (if applicable)
• Any personal medical conditions

6.2. Safety During the Safari

Your safety is our priority. You agree to follow all safety instructions provided by your guide or any Baharidust Adventure representative. This includes:

• Remaining inside the vehicle during game drives unless instructed otherwise
• Not feeding or approaching wildlife
• Following all park rules and regulations
• Disclosing any medical conditions or allergies to your guide

We reserve the right to refuse service to anyone who poses a safety risk to themselves or others.

7. Liability

7.1. Our Liability

Baharidust Adventure acts as a tour operator and will provide services with reasonable skill and care. However, we are not liable for:

• Any injury, loss, or damage caused by events beyond our reasonable control (force majeure)
• Loss or damage to personal belongings
• Delays, cancellations, or changes caused by third-party providers (e.g., airlines, lodges, etc.)
• Any expenses incurred as a result of changes to the itinerary

7.2. Your Liability

You are responsible for any damage caused to vehicles, equipment, or property during your safari. You agree to indemnify and hold Baharidust Adventure harmless from any claims arising from your actions or negligence.

7.3. Limitation of Liability

To the maximum extent permitted by law, our total liability to you is limited to the amount you paid for your safari. We are not liable for any indirect, incidental, or consequential damages.

8. Intellectual Property

All content on the Baharidust Adventure website, including text, images, logos, videos, and graphics, is our intellectual property or licensed to us. You may not reproduce, distribute, or modify any content without our prior written consent.

By sharing photos, reviews, or testimonials with us, you grant us the right to use them for marketing and promotional purposes (with credit given where appropriate).

9. User Conduct

When using our website or services, you agree not to:

• Violate any applicable laws or regulations
• Impersonate any person or entity
• Engage in fraudulent or deceptive activities
• Post or transmit harmful, offensive, or unlawful content
• Interfere with the security or operation of our website

We reserve the right to terminate your access to our services if you violate these Terms.

10. Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations under these Terms due to circumstances beyond their reasonable control, including but not limited to:

• Natural disasters (earthquakes, floods, storms)
• Political instability, war, or terrorism
• Pandemics and public health emergencies
• Government restrictions or travel bans
• Strikes or labor disputes

If a force majeure event occurs, we will work with you to find a suitable solution, which may include rescheduling your safari or issuing a credit.

11. Privacy Policy

Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Tanzania.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the original intent.
